Colorado drivers will now be fined for holding a phone while behind the wheel 

State and local officials are hoping to raise awareness regarding distracted driving in Colorado.

A new state law prohibits motorists in Colorado from holding their phones for any reason while driving, expanding the ban on using cellphones beyond just texting.

The law went into effect Jan. 1 alongside several other pieces of legislation

Drivers using their phones — unless it is through a hands-free accessory — can now be fined $75 and face two license suspension points for their first offense. Repeat offenders could face higher fines and more points on their license. 



First-time violators can have their charge dismissed if they provide proof of purchasing a hands-free accessory. Hands-free accessories include Bluetooth headsets, dashboard mounts, CarPlay and Android auto and car speaker phone systems.

The move is aimed at reducing the risk of crashes.

Distracted driving is the third cause of traffic-related crashes in Colorado, with 698 deaths due to distracted driving between 2013 and 2023, according to the department. 

The law exempts individuals reporting emergencies, utility workers, code enforcement officers, animal protection officers, first responders and individuals in parked vehicles to ensure critical communication is not hindered in certain situations. 

Colorado now joins 29 other states in prohibiting the use of hand-held mobile devices while driving.
